There is currently a schism in Canadian regulatory law regarding how easy it should be for businesses to challenge government regulations in court. Recent decisions by the Federal Court of Appeal and the Alberta Court of Appeal have taken opposing views on this issue and courts in other provinces, such as Ontario and British Columbia, are likely to weigh in during the course of 2023.

Environmental, social and governance (ESG) concerns have been increasingly on the radar of Canadian companies in the past few years, garnering significant attention and discourse.
